Welcome to Polatty Landscaping and Lawncare. By using our website, requesting an estimate, scheduling a service, or working with our team, you agree to the following Terms and Conditions.
1. Acceptance of Terms
By accessing this website or using our services, you agree to these Terms and Conditions and all applicable laws and regulations. If you do not agree with these terms, please do not use our website or services.
2. Services
Polatty Landscaping and Lawncare provides outdoor property services, including landscaping, hardscaping, landscape installation, irrigation, and lawn care.
The exact scope of work, pricing, materials, timeline, and project details will be discussed and agreed upon before work begins. Any changes requested after approval may affect the final price and completion timeline.
Polatty Landscaping and Lawncare reserves the right to refuse, pause, or discontinue work if a project is unsafe, outside our service scope, or if these Terms are violated.
3. Quotes and Estimates
Estimates may be provided using photos, property information, measurements, or an in-person inspection.
Final pricing may change if the property size, site conditions, access, materials, labor requirements, or project scope differ from the information originally provided.
Unless stated otherwise in writing, estimates are not guaranteed final prices.
4. Client Responsibilities
Clients agree to:
Provide accurate information about the property and requested work.
Provide safe and reasonable access to the work area.
Remove vehicles, furniture, decorations, toys, and other personal property from the work area when requested.
Secure pets and keep people away from active work areas.
Inform Polatty Landscaping and Lawncare of known underground lines, private utilities, irrigation systems, septic systems, drainage problems, property boundaries, or other potential hazards.
Obtain any required homeowner association approvals unless otherwise agreed in writing.
Failure to properly prepare the property or provide necessary access may result in delays, rescheduling, or additional charges.
5. Payment Terms
Payment terms will be explained before work begins. Payment is due according to the approved estimate, invoice, or written agreement.
A deposit may be required for projects involving materials, equipment, or substantial labor.
Late or missed payments may result in work being paused, additional charges, collection efforts, or refusal of future service.
6. Cancellations and Rescheduling
Clients should provide reasonable notice when canceling or rescheduling an appointment.
Deposits used to purchase materials or reserve substantial project time may be nonrefundable, as stated in the estimate or agreement.
Polatty Landscaping and Lawncare may reschedule work because of weather, unsafe conditions, material delays, equipment problems, emergencies, or other circumstances outside our reasonable control.
7. Property Conditions and Project Limitations
Polatty Landscaping and Lawncare takes reasonable care while working on each property. However, we are not responsible for damage caused by pre-existing conditions or undisclosed hazards.
These conditions may include:
Poor drainage or unstable soil
Hidden roots, rocks, debris, or underground structures
Existing irrigation or utility damage
Improperly installed materials
Property-line disputes
Pest, disease, or weather-related damage
Existing damage to lawns, plants, structures, or hardscape surfaces
Landscaping and excavation work may reveal existing problems that were not visible before work began.
8. Plants, Lawns, and Irrigation
The health of grass, plants, and landscaping can be affected by watering, weather, soil conditions, pests, disease, sunlight, and ongoing maintenance.
After installation, clients are responsible for following any watering and maintenance instructions provided.
Polatty Landscaping and Lawncare does not guarantee the survival or continued condition of plants, grass, or other living materials unless a specific written warranty is included in the project agreement.
9. Satisfaction and Workmanship
We aim to provide dependable service and quality work on every project.
Any concerns should be reported as soon as possible after the work is completed so we can inspect the issue.
Any return visits, adjustments, touch-ups, or corrections will be handled at the discretion of Polatty Landscaping and Lawncare and must relate directly to the original agreed-upon work.
10. Photos and Marketing
Polatty Landscaping and Lawncare may take photos or videos of work for documentation, website content, advertising, social media, and other marketing purposes.
Clients may request in writing that certain photos or videos not be used publicly.
11. Intellectual Property
All website content, including text, branding, images, graphics, design, and layout, belongs to Polatty Landscaping and Lawncare or is used with permission.
Website content may not be copied, reproduced, distributed, or reused without written permission.
Clients retain ownership of materials they provide to Polatty Landscaping and Lawncare.
12. Limitation of Liability
To the fullest extent permitted by law, Polatty Landscaping and Lawncare is not responsible for indirect, incidental, special, or consequential damages connected to the use of our website or services.
Our liability for a claim related to a particular project will not exceed the amount paid for the specific service involved, unless otherwise required by law.
13. Termination of Service
Polatty Landscaping and Lawncare may refuse, suspend, or terminate service because of:
Unsafe working conditions
Nonpayment
Threatening, abusive, or inappropriate behavior
Inaccurate or withheld property information
Violations of these Terms
Clients remain responsible for completed work, ordered materials, and other costs incurred before termination.
14. Governing Law
These Terms and Conditions are governed by the laws of the State of South Carolina.
Any disputes will be handled in the appropriate courts of South Carolina unless otherwise required by law.
15. Changes to These Terms
Polatty Landscaping and Lawncare may update these Terms and Conditions periodically.
Changes will be posted on this page with a revised effective date.
